1. What this page does
The Musician Guild lets users upload recordings of real performances. If you believe an upload infringes your copyright, notify us under this page.
Under section 88B of the Copyright Ordinance (Cap. 528), a service provider that meets the stated conditions is not liable in damages, or for any other pecuniary remedy, for copyright infringement on its platform. This arrangement is called a safe harbour. It does not mean we promise that every upload is non-infringing.
We handle notices under the Commerce and Economic Development Bureau Code of Practice (February 2023). A "working day" on this page does not include a public holiday, or a day of a gale warning or a black rainstorm warning.
2. Designated agent and how to send a notice
- Designated agent: Compliance Manager
- Service provider: HMCHK Music
- Address: Room 1904, 19/F, Tong Chun Commercial Building, Dundas Street, Mong Kok, Hong Kong
- How to send: email info@h-m-c-musicgroup.com (both a notice of alleged infringement and a counter notice go to the designated agent this way)
3. What a notice of alleged infringement must contain (section 88C)
The notice must be in writing, signed or otherwise authenticated by the copyright owner or the owner's authorised representative, and sent to the designated agent at the email above. You may use Form A in the annex to the Code of Practice. We do not require our own form, so long as the notice contains all of the following:
- the complainant's name, an address in Hong Kong for service, and enough other details to contact the complainant;
- enough detail to identify the copyright work said to be infringed;
- the material or activity said to infringe (or a link or pointer to it);
- enough detail for us to locate that material, activity, link or pointer (for example a URL);
- how the material or activity infringes the copyright owner's rights;
- a statement that the complainant believes in good faith that the use or activity complained of is not authorised by law, and is not authorised by the copyright owner or the owner's representative;
- a statement that the complainant asks us (i) to send a copy of the notice to the user of the upload account, and (ii) where applicable, to remove the material or to disable access to the material or activity;
- a declaration that the notice is true and accurate to the best of the complainant's knowledge and belief; that the complainant is the copyright owner or is authorised to act; and that the complainant understands a false statement may lead to criminal or civil liability.
A notice that does not meet these requirements has no legal effect (section 88C(4)). If something is missing, we tell the complainant as soon as practicable.
4. What we do after a notice
- We acknowledge receipt (this may be an automatic reply).
- As soon as practicable we remove the material, or we disable access to the material or activity.
- We promptly notify the uploader in writing, and we enclose a copy of the notice; a statement that the material has been removed or that access has been disabled; a statement that, to dispute it, the uploader may send a counter notice within 20 working days after receiving our notice; information on the legal consequences of copyright infringement in Hong Kong, and a reminder that the uploader may take independent legal advice or contact the complainant; and the repeat-infringement policy on this page.
If we ourselves know that infringement has occurred, or know facts that would inevitably lead to that conclusion, we may also remove the material or disable access, and we notify the uploader in writing (section 88D).
5. Counter notice (section 88E)
If the uploader believes the material was removed because of a mistake or a misidentification, the uploader may, within 20 working days after receiving our notice, send the designated agent a counter notice that is in writing and signed or otherwise authenticated, at the email above. The counter notice disputes or denies the alleged infringement and asks us to restore the material. You may use Form B in the annex to the Code of Practice. It must contain:
- the uploader's name, an address in Hong Kong for service, and enough other details to contact the uploader;
- the material or activity that was removed or disabled, and where it appeared;
- a statement that the uploader believes in good faith that the removal or disabling was the result of a mistake or misidentification;
- the grounds for that belief;
- if the uploader is an individual: whether the uploader agrees that we may disclose the personal data in the counter notice to the complainant;
- a declaration that the counter notice is true and accurate to the best of the uploader's knowledge and belief, and that the uploader understands a false statement may lead to criminal or civil liability.
A counter notice that does not meet these requirements does not require us to restore the material (section 88E(4)).
6. What we do after a counter notice
- We acknowledge receipt (this may be an automatic reply).
- We promptly send a copy of the counter notice to the complainant. If the uploader chose not to disclose personal data, we remove that data from the copy.
- We tell the complainant that, unless within 20 working days from our notice the complainant tells our designated agent in writing that court proceedings seeking an order have been commenced in Hong Kong, we will restore the material.
- If we do not receive that notice of proceedings, we take reasonable steps to restore the material or to restore access within 25 working days after the notice we sent to the complainant (section 88H).
7. Repeat infringement
If an account receives valid notices, or in another appropriate case, we may suspend or end that account's upload function, or the account. We give reasons in writing.
8. Performers' rights and other people's consent
An uploaded recording may also involve performers' rights under Part III of the Copyright Ordinance, or the privacy of an identifiable person in the recording. If your complaint is about those rights, use the same email and identify the performer or person, the recording and where it is. We deal with each case on its own facts.
9. False statements
Send a notice or a counter notice only if you believe in good faith that it is true. Knowingly or recklessly making a statement that is false in a material particular, in a notice or a counter notice, is a criminal offence. On conviction the penalty is a fine at level 2 (currently HK$5,000) and imprisonment for 2 years (section 88F). There may also be liability in damages to a person who suffers loss (section 88G).
10. Records
We keep records of infringement notices, the notices we send to uploaders, and counter notices for at least 18 months.
